All real estate services are provided by licensed real estate professionals affiliated with Keller Williams Capital Realty and licensed in the State of Indiana.

Horton Team is not a separate brokerage entity.

Each agent is an independent contractor unless otherwise stated.

Services are offered exclusively within the State of Indiana.

2. No Agency Relationship Created

Use of this website, submission of any form, registration for alerts, text messaging, AI chat interaction, or email communication does not create an agency relationship.

An agency relationship is formed only through a written agreement signed in compliance with Indiana law.

3. Non-Reliance Disclaimer

Information provided on this website is for general informational purposes only.

You acknowledge that:

We are not liable for RealScout system errors or interruptions.

6. Communications Consent (TCPA Compliance)

By submitting your contact information through:

Facebook Lead Ads

SMS opt-ins

Open house registrations

Third-party platforms (Zillow, ReferralExchange, etc.)

AI chat

You provide prior express written consent to be contacted by:

Phone calls

Artificial or prerecorded voice where permitted

Messaging frequency varies.

Consent is not a condition of purchasing services.

7. Do Not Call (DNC) Compliance

You assume the risk of transmitting information electronically.

We are not liable for intercepted, delayed, or corrupted communications.

11. Limitation of Liability

To the fullest extent permitted by law:

Total liability shall not exceed $100.

12. Indemnification

You agree to indemnify and hold harmless Horton Team and Keller Williams Capital Realty from claims arising from:

Violation of these Terms

13. Arbitration & Class Action Waiver

All disputes shall be resolved exclusively through binding arbitration in Indiana under the rules of the American Arbitration Association.

You waive:

Jury trial rights

Participation in class action lawsuits

14. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including:

Natural disasters

System outages

MLS service interruptions

Government actions

Cyberattacks

15. Fair Housing
